1. Introduction

At EzSignly, we prioritize the protection of your personal information. This Privacy Notice explains how EzSignly, Inc. and its affiliates (“EzSignly,” “we,” “our,” or “us”) collect, use, store, disclose, and process personal information in connection with your use of our websites, including ezsignly.com, our mobile applications, web clients, and any other services, products, or platforms that link to this Privacy Notice.

By accessing or using our Services, you acknowledge and agree that your personal information will be collected and used in accordance with the practices described in this Privacy Notice.

In certain situations, we may process personal information pursuant to a written agreement with a third-party entity (such as your employer or service provider). In such cases, that third party may control how your information is used, and their terms—not this Notice—may apply. If you believe your information is being processed on behalf of a third-party organization, we recommend contacting them directly regarding your data and privacy rights.

Please note, this Privacy Notice does not apply to third-party websites, services, or applications that may be accessible through our Services. We encourage you to review the privacy policies of those third parties before interacting with them or providing your information.

EzSignly’s platform enables individuals and organizations to digitally execute, track, and verify electronic transactions—such as signing agreements, contracts, or consent forms. To fulfill these services, we may collect and log certain information that supports the authenticity and enforceability of those transactions, such as signer names, email addresses, device and browser details, timestamps, IP addresses, and usage logs.

For more about your rights and choices, please refer to Sections 5 and 8 of this Privacy Notice.

  • Add users to a team or shared workspace
  • Refer a friend or share feedback
  • Input recipient details for document routing

If you prefer not to share this information, certain functionalities like sending or receiving signature requests may be limited.

Examples of personal information we may collect include:

  • Identifiers and Contact Details: Full name, email address, phone number, mailing address, or signature image
  • Account Information: Login credentials, profile photo (if uploaded), and contact preferences

Personal Information Collected Automatically

When you interact with our Services—including browsing without logging in—we may automatically collect information using cookies, device identifiers, and similar technologies. For opt-out options, please see Section 5 & 12.

We collect technical and usage data, such as:

  • Device Data: IP address, browser type, operating system, and hardware settings
  • Usage Logs: Access times, clickstreams, session duration, page views, referral links, and crash reports
  • Transactional Metadata: IP addresses and verification methods used by signers, timestamp logs, and document activity trails
  • Marketing and Analytics Data: User preferences, campaign engagement, and product interest inferred from usage behavior

Some of this information is stored using cookies and other tracking technologies. To learn more or manage cookie preferences, please visit our Section 12.

Personal Information from Other Sources

Subject to applicable laws, we may receive personal information about you from external sources, such as:

  • Third-Party Services and Integrations: You may connect third-party tools (e.g., Google Workspace, Dropbox, CRM platforms) with your EzSignly account. These services may provide us access to contact details or document metadata. You are responsible for reviewing and approving any third-party permissions.
  • Marketing Partners and Affiliates: We may receive information from co-marketing programs, event sponsors, or affiliates under common ownership.
  • Other EzSignly Users: Customers who initiate a document for your review or signature may provide your email address, name, or other identifying details.
  • We may combine this information with the data we collect directly from you to improve your user experience or fulfill our contractual obligations.

Data Processed on Behalf of Customers

When our business customers use certain features of the EzSignly Services, we may process and store limited personal information solely on their behalf, acting as a data processor. For example, when a customer uploads agreements, contracts, or other documents for electronic signature or review, we process those materials under their instructions and for the purpose of fulfilling their use of the Services. In such cases, the customer acts as the data controller and is responsible for determining the purposes and lawful basis of the data processing.

In some circumstances, including where required to comply with legal obligations or for operational purposes—such as retaining audit trails, signature logs, or transactional metadata—we may act as both a data processor and a data controller. This may apply to services beyond core signing functionality, such as identity verification or analytics features.

If you are using our Services because a customer (e.g., your employer, service provider, or business partner) has requested your participation, and you have questions regarding how your personal information is handled, you should first contact that customer directly. Where we receive data rights requests relating to instances in which we act as a processor, we will promptly refer such inquiries to the appropriate data controller for further handling.

3. Use of Personal Information and Lawful Bases for Processing

Subject to applicable laws, EzSignly collects and uses personal information to provide, operate, maintain, and improve our Services; develop new features; and communicate relevant information about our products and services, including marketing communications where permitted.

For more detailed information on how we use specific categories of personal data, including relevant legal bases, please see the section titled “Further Information on the Personal Information We Process and Our Purposes” below.

Lawful Basis for Processing Your Personal Information

Where data protection laws (such as the General Data Protection Regulation (GDPR) or equivalent laws in other jurisdictions) require a lawful basis for processing, and where EzSignly acts as a data controller, our legal basis for processing your personal information will depend on the nature of the information and the context in which it is collected or used.

In most cases, we process your personal information under one or more of the following lawful bases:

Contractual Necessity: Where the data is required to fulfill our contractual obligations to you (e.g., providing access to your account, delivering signed documents).

Legitimate Interests: Where the processing supports our business operations (e.g., improving product performance, ensuring platform security, fraud prevention), provided these interests are not overridden by your fundamental rights and freedoms.

Legal Obligations: Where processing is necessary to comply with applicable laws or respond to lawful requests from public authorities.

Vital Interests: In rare cases, where processing is necessary to protect your vital interests or those of another individual.

Consent: Where required by law, we will obtain your express consent before processing your personal information (e.g., for certain types of marketing or when processing sensitive personal information).

If we process sensitive personal information (such as biometric identifiers or government-issued ID numbers), we will ensure that one of the permitted grounds for processing under applicable law also applies.

When We Act as a Data Processor

When EzSignly processes personal data on behalf of a customer (such as when hosting documents uploaded for signing), the customer is considered the data controller, and they are responsible for determining the appropriate lawful basis. If you have questions about the legal basis for processing in such cases, please contact the relevant organization that requested your participation in a transaction via EzSignly.

Further Information on the Personal Information We Process and Our Purposes

The table below outlines examples of how EzSignly processes personal information, the categories of personal information involved, and the corresponding legal bases for doing so, where applicable. These examples are illustrative and not intended to be exhaustive.

Please note that applicable lawful bases may vary depending on your jurisdiction and specific use of the Services. If you have questions regarding the lawful basis relied upon in your case, or require further clarification, you may contact us using the information provided in Section 11 of this Privacy Notice.

We will provide notice of any material changes to privacy practices following such a transaction.

In general, this means your personal information may be retained:
